Why do we have copyright? The purpose is to secure credit for intellectual property. We're obviously giving credit to Bungie for its original work. (We realize that Microsoft isn't worth shit; it has a blatant disregard for everything and only cares about making money as fast as possbile. It would steal our money right from our bank accounts if Uncle Sam wouldn't shut it down.) Correct me if I'm wrong, but Halo is no longer published. It's a "dead" game, as far as Bungie is concerned. (Can you buy Halo directly from Bungie anymore?) Any work that is no longer published is fair game; I don't consider it illegal to modify it -- meaning that as long as we don't sell our mods without permission from Bungie first, we're in the clear.
...not to mention that by modding this game, we're simply extending the life of Halo and creating additional advertisement for Bungie (and, yes, I hate to say it, for Microsoft). Heck, they should be PAYING us to mod their game. And we deserve every bit of credit for our ideas. It's a double-standard.
There are exceptions that hover around bullshit legal wording. (Kind of like flies around a piece of excrement.) For example, parodies are often exempt from copyright. Legal terms are often completely bull - consider "sales" versus "donations." You can say something like, "With a donation of $25, I will give you my Halo mod for free." However, you cannot say "I will sell you my Halo mod for $25." No matter how you slice it, without $25, you ain't gettin' my mod.
I hate this legal crap, and now you know why.
